Lower Test Enforcement Undertaking
In 2021, diesel oil leaked from a depot at Nursling Industrial Estate, Southampton, entering the ground and tidal reaches of the River Test. The spill originated from WFL (UK) Ltd and raised significant concerns because the River Test is a nationally important chalk river and designated Site of Special Scientific Interest (SSSI). The incident prompted questions about its environmental impact and the actions required to prevent future harm.
Following the company’s positive engagement, the Environment Agency offered WFL (UK) Ltd an Enforcement Undertaking (EU) as an alternative to prosecution. This mechanism ensures that the polluter funds meaningful environmental improvements within the affected catchment, rather than paying a penalty to the Treasury.
As part of this process, Wessex Rivers Trust were invited to propose local river enhancement projects that could deliver meaningful ecological benefits. Two suitable projects were initially identified and accepted, with the Trust acting under confidentiality while details were agreed.
Subsequently, one project was found to be prohibitively expensive. With the approval of the Environment Agency, the funding has instead been split between a restoration project on Tanners Brook and another within the lower River Test. Both initiatives are now progressing, with practical works planned for 2026–27. All EU funds provided by WFL (UK) Ltd will be used exclusively for these agreed projects.
